The National Environmental Management Act, Act 108 of 1998 (NEMA) includes important provisions in Section 32, which is outlined below for your convenience: Specialist reports and assessments (1) An applicant or the Environmental Assessment Practitioner (EAP) overseeing an application has the option to hire an independent individual to conduct a specialist study or assessment. (2) The individual mentioned in sub-regulation (1) must adhere to the stipulations of Regulation 17. (3) Any specialist report or assessment created under these Regulations must include – (a) information about – (i) the individual who prepared the report; and (ii) that individual's qualifications for conducting the specialist study or assessment; (b) a declaration of independence in a format specified by the relevant authority; (c) the scope and purpose of the report; (d) a description of the methodology used in the report or assessment; (e) any assumptions made and any uncertainties or knowledge gaps identified; (f) an overview of the findings and their potential environmental implications, including any identified alternatives related to the proposed activity; (g) recommendations for mitigation measures for consideration by the applicant and the relevant authority; (h) details of the consultation process conducted during the study; (i) a summary and copies of any feedback received during the consultation; and (j) any additional information requested by the relevant authority.
