DEFINITIONS - **Alien Vegetation**: Undesirable plant species categorized under the Conservation of Agricultural Resources Act (CARA) and the National Environmental Management: Biodiversity Act. - **Environmental Management Plan (EMP)**: A tool to prevent, minimize, and enhance environmental impacts associated with construction activities. - **Designated Environmental Officer (DEO)**: The individual tasked with overseeing EMP implementation by the Contractor on-site. ### 3. LEGAL REQUIREMENTS The road maintenance operations will comply with applicable environmental legislation, including but not limited to: - **National Environmental Management Act (NEMA)** - **Conservation of Agricultural Resources Act** - **National Water Act** - **National Environmental Management: Biodiversity Act** Compliance with these laws is mandatory, and deviations can lead to penalties. ### 4. ADMINISTRATION OF ENVIRONMENTAL OBLIGATIONS Proper administration of environmental obligations includes: - Redistribution of responsibilities for monitoring environmental compliance - Regular environmental assessments and reporting - Stakeholder engagement processes with local communities **Responsible Parties**: - **SANRAL**: Overall accountability for ensuring environmental impacts are managed. - **The Engineer**: Oversees compliance by the Contractor. - **The Contractor**: Responsible for implementing measures outlined in the EMP. - **The Designated Environmental Officer (DEO)**: Responsible for daily compliance monitoring and record-keeping. ### 5. ENVIRONMENTAL TRAINING AND AWARENESS Before construction begins, all personnel (including subcontractors) must undergo environmental management training. Mitigation strategies must be employed to manage these risks effectively. ### 7. ENVIRONMENTAL MANAGEMENT AND MITIGATION MEASURES #### Site Establishment - A comprehensive site plan must be submitted for approvals prior to establishing work areas. - Waste management strategies must ensure proper disposal and recycling. #### Vegetation Management - Preserving indigenous vegetation while managing areas of disturbance. - Prohibition of alien plant species and requirement to oversee re-establishment of indigenous species post-construction. #### Water Management - Each construction site must include drinking water provisions, and effluent waters must be correctly disposed of or treated. ### 8. AREAS OF SPECIFIC IMPORTANCE Sensitive ecological zones must be identified and protected according to project specifications. Procedures will be in place should archaeological or significant historical resources be unearthed. ### 9. REHABILITATION Rehabilitation practices will ensure the return of the disturbed sites to their original state, prioritizing indigenous species for replanting. All rehabilitation must be completed to the satisfaction of SANRAL and relevant authorities. ### 10. RECORD KEEPING The DEO will maintain detailed records of compliance and non-compliance incidents. Monthly reports will summarize environmental performance and record complaints and remedial actions taken. ### 11. COMPLIANCE AND PENALTIES Immediate corrective actions must occur following any notice of non-compliance. Continued non-compliance could lead to financial penalties to SANRAL, which will be passed to the responsible contractor. ### 12. PROJECT-SPECIFIC CONDITIONS This EMP serves as a foundational document for site-specific Environmental Management Programmes. The Contractor acknowledges that consistent improvement in process and environmental management practices is encouraged, with formal proposals for enhancement welcomed.
